This is being called a win for now.
But it could open a big can of worms if it falls the wrong way.
DoD has a similar situation between the volumes of regulations we must follow that are vague or up for interpretation.
DoD’s policy is that a “Policy” may be established at the lowest level or higher that interprets a regulations ambuigities in favor of the agencies goals. But this interpretation cannot add further restrictive requirements but only interpret the intent of the original regulatory guidance.
This is a good approach because many regulations are written so there is a grey area to allow the different agencies to adjust the regulation to fit their mission.
This approach would not allow Pittsburg to Ban Guns when the state has already has already decided that gun bans were illegal in this case.
