Not sure I got the category right, but definitely wanted to share this with everyone and get feedback. Has anyone encountered similar problems? How was it handled? Suggestions for how to handle in the future?
Not a lawyer: Iâve heard of similar concepts with regard to 1A video recording from public land. If there is no expectation of privacy, there is no prohibition against recording or observing.
To construct such an expectation of privacy, the owner would need to do something like build an opaque wall or put up trespassing notices with close enough spacing for the state to recognize them as legally binding.
i.e. no trespassing signs
I knew TWRA has ignored signs posting land, during hunting season, but this is the first I remember seeing/hearing of them putting game cameras on private land.
Ag Dept also seems to ignore signs posting land, as Iâve heard of people with hobby farms getting bent out of shape over discovering somebody inspecting their crops, then identifying themselves as Ag inspectors. Their assumption seems to be that anyone with more than a backyard vegetable patch, is âengaged in the businessâŠâ and therefore subject to inspection. I donât have any idea how often that occurs, though.
Property tax office seems to also think they have inspection authority, though I think that is now mainly done by periodically updating aerial photomaps of the county, then comparing new maps with old, to see if any structures were added.
Edit: Seems to be a pattern of âtax menâ ignoring signs posting land. TWRA is funded mainly by hunting and fishing licensing fees, and by fines collected from people caught violating hunting and fishing regs, so they are sort of âtax menâ.

Isnât that how (more or less) the person got into trouble and had his house forcibly raided in the wee hours of the morning (open up or we will break down the door)? I am thinking something more subtle, but still gets the job done. Move the cameras to public property?

Unless I misremember he took them down and possessed them. The landowner has no control over what happens to the property of another when left on the landowners land. It could be shot and left there by pretty much anyone. Just like the folks who left the cameras without permission, anyone else could walk the land and shoot it up.
A bunch of years ago Maine DFG (DFW? IDK) put a stuffed deer on a persons land as bait for folks jacking deer, the landowner had no tolerance for their shenanigans. He found it and took it. It was on his land so he owned it. They asked pretty please could have it back? I guess it all depends on the laws of the state.

So then Monsanto threatens them with copyright infringement if they donât destroy their infected fields! Think itâs made up look it up, not too hard to find. It really does make you wonder what theyâd do if you accidentally shot one of these fools. I mean truly by accident: say you do shooting on your private land and one of these guys in full camo is trespassing, sneaking around, and hiding downrange.
